Want to evict a tenent

Greeting,

I recently bought a house with 2 suites. I agreed to let one of the tenants stay when I bought. Its now been 3 months, and the tenant needs to go. How do I get rid of her legally ? I was thinking of writing her a (polite) eviction giving her 60 days notice and stating that its due to renovations that I would like to do to the suite. Is there a proper document that is available for this, or is typed up good enough ?

What info/wording will be required to cover my (you know what) ? I reside in BC.

Im not sure how it works in BC but in Ontario if there is a lease between you and the tenant, and the tenant meets their obligations theres not much you can do.
You have to reach an agreement with the tenant because you`re breaking the lease.(pobably pay them)

If the there is no lease than its a month to month implied agreement. You can ask the tenant to leave for 2 reasons:

you`re selling the property

you`re moving in yourself(if you live there already ther may be a provision for family member, im not sure)

you`re renovating

the problem is that when you`re renovating the tenant has the right to claim that unit after the renovation its called " security of tenant" they are a human being and you have to keep in mind their intersts as well So if you tell them to move out because you`re fixing up the place they can say "how about I come back when you`re done"

usually that doesnt happen as nobody wants to move back and forth.

also you have to give them 60 days notice regardless. and if its a lease you have to wait to the end of term and gove them notice 120 days bafore the lease expiration date asking them to vacate at that time.

you have to check your local regulations but these are just some of the points to consider. also the regulation change all the time so check the local tenant board.

The best place to go with these questions is to your RTB, I find most often your questions will be anwsered on their web site, it is hard for a forum to anwser these questions when we are from all across Canada.

Here goes my question, if you ask a tenant to move out for renovations, and at the end of the reno the tenant wants to move back in, can you just set the rent at the new market value? Or do you have to give it to them at the old rate, unless you go to the RTB to increase rent about the set yearly increase?
