TENANT SMOKING IN MY BASEMENT SUITE

Hi all,

I have a tenant smoking in my basement suite. I have warned her twice verbally.
I am in Alberta. What are the legalities of eviction in this province.
She also has an unauthorized person living there.

Any suggestions??

If your lease specifically states that she is not allowed to smoke in the unit and you can prove she is smoking you can evict here for a serious breach of the lease. It may be hard to prove this, but if she has an unauthorized person living there as well and your lease stipulates it is just her you could evict for that reason. Best case you put both breaches in the eviction notice and move forward, or to expedite (since she won`t change it appears), go directly to Residential Tenancy Dispute Resolution Services and go through the eviction process.
