Could anyone point me to a good contact to evicting a tenant and "guest/sub-tenant" in Kitchener / Waterloo....
too many visits from the Police and neighbours not to happy either...

Follow Adam`s advise. Look up a paralegal on www.wrama.com and get help. Unless you have all of your info and timing right - you will end up with these tenants staying longer than you wish and not paying rent... and destroying your property...
How did you get these tenants? They sound like the one`s that I kicked out
They tend to migrate up and down Moore and Duke year after year (or apx every 120 days for some)
Occasionally moving farther west along Cedar or Madison.
Its amazing how four months of rent can cover living expenses for an entire year.

What reason are you using to justify the eviction?
Do you live in the same building or are there other tenants in the same building?
How long has the unwanted guest been in the unit?

Gave N7 yesterday based on dammage to unit (door kicked in and broken off hinges) and safety of other occupants. There have been several calls to the police for noise and physical altercations. The other tenant on ther main floor does not want his girlfriend in the back hall alone anymore and most recently the `guests` physically choked the paying tenant. (he did not want to make a complaint to police as he still has to live there) The `guests` have signed a rental form with my tenant but only paid 2 mos rent (they have been there since early Dec) I do not have any type of agreement with the `guests` and as I understand from talking several times with the LTB I do not have any
way within the LTB to get them out.
I spoke with the police this week when they were last over when the choking occured and they said the `guests` were not likely to leave on their own based on past experience with them.
I am going to ask the other main floor tenant for a statement regarding noise and concern for personal safety as well.
Any other thoughts if I have to take them to court would be appreciated... lunch anyone?

Sounds like you should have more than enough to get an eviction. Unless you are experienced get help. Attend some LTB hearings in advance to get a feel for the environment.You must document and detail every incident. Get witnesses if possible. It is all in the details and how prepared you are.
Post a inspection notice and complete a inspection prior to your hearing. Ask your tenants if they have any maintenance issues and address them, have them sign a acceptance of work completed or that they have no issues. Duty council will blind side you on maintenance. Always have a witness present.
You must find out the identity of your freeloader tenant. You can not evict a tenant if you do not have there name on the eviction form.
